These Terms of Service (“Terms”) govern your access to and use of the services provided by Xclusive Contracting LLC (“we,” “us,” or “our”), including our website and any communications you receive from us. By submitting our contact or estimate-request form or engaging our services, you agree to these Terms.
1. Services
Xclusive Contracting LLC provides residential and commercial contracting services including, but not limited to, interior and exterior painting, drywall installation and repair, texturing, and stucco application and repair. We are licensed, bonded, and insured in the State of Arizona (AZ ROC #355811 - Drywall & Paint; AZ ROC #359593 - Stucco).
2. SMS Communications
SMS consent is not a condition of purchasing any goods or services. You are not required to consent to receive SMS messages in order to work with us or receive our services.
By opting in to our SMS programs through our contact form, you agree to the following terms:
Transactional SMS Program: You may receive text messages related to your project or services, such as appointment reminders, estimate confirmations, scheduling updates, and service notifications from Xclusive Contracting LLC.
Marketing SMS Program: If you separately opt in, you may receive promotional text messages including special offers, seasonal promotions, and company news from Xclusive Contracting LLC. This program is entirely optional.
For all SMS communications:
- Message type: Transactional messages include appointment reminders, estimate confirmations, and service notifications. Marketing messages include promotional offers and company updates.
- Message frequency: Message frequency may vary depending on your project activity and preferences.
- Message & data rates: Message and data rates may apply depending on your mobile carrier plan.
- Help: Reply HELP to any message for assistance.
- Opt-out: Reply STOP at any time to unsubscribe. You will receive a one-time confirmation and no further messages will be sent.
- Carrier liability: Carriers are not liable for delayed or undelivered messages.
- Age restriction: You must be 18 years of age or older to consent to receive SMS messages from Xclusive Contracting LLC.
- SMS consent and phone numbers provided for SMS purposes are never shared with third parties for their own marketing purposes.
3. Estimates & Project Work
Estimates provided are based on the information and site conditions known at the time. Final pricing, scope, and scheduling are governed by the written project agreement signed by you and Xclusive Contracting LLC. You agree to provide accurate and truthful information when submitting our forms and requesting estimates.
4. Warranty
Xclusive Contracting LLC stands behind its workmanship and provides a two-year (2-year) warranty on labor for qualifying projects, as detailed in your written project agreement. Warranty terms, coverage, and exclusions are described in that agreement.
5. Acceptable Use
You agree not to use our services or communications for any unlawful purpose or in any way that could damage, disable, or impair our services. You agree to provide accurate and truthful information when submitting our forms.
6. Limitation of Liability
Xclusive Contracting LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or reliance on our communications. Our total liability in any matter shall not exceed the amount paid by you for the specific service in question.
7. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy explains how we collect, use, and protect your personal information, including SMS consent data.
8. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised “Last Updated” date. Continued use of our services after any changes constitutes your acceptance of the updated Terms.
9. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Pinal County, Arizona.
